What count in MPEG4 is frame  difference... so if your black is not that
black after  all, that does not hurt  as long as it  stays constant. And
there is  no "black MB"  recognition but there  is a zero  difference MB
detection (with thresholding, just a detail i won't comment here). These
MBs are skipped.
